Privacy notice

How we handle the details you send us, and what you can ask us to do with them.

Template · to be reviewed by your gestor or lawyer before launch

01 · Who is responsible

The data controller is Andreas Frei, trading as Segunda Casa Mallorca, in Llucmajor, Mallorca, Spain. You can reach us at office@segundacasamallorca.es, and we will give you a postal address on request.

We have not appointed a data protection officer, as our processing does not require one. Enquiries about data go to the address above and are answered by us personally.

02 · What we collect

Only what you type into the enquiry form: your name, email address, telephone number if you give one, the location of the property, and whatever you choose to write about it. Nothing is required beyond a name and an email address.

We use no analytics, no advertising tools and no tracking cookies. The site sets no cookies of its own. Our web host records standard server logs, including IP addresses, for security and error diagnosis.

03 · Why, and on what basis

We use your details for one purpose: to read your enquiry and reply to it. The legal basis is your request to enter into a relationship with us, under Article 6(1)(b) GDPR, and our legitimate interest in answering correspondence, under Article 6(1)(f).

We never send marketing, and we never add you to a mailing list. If we later become your estate office, the property file is processed under the service contract between us.

04 · Who else sees it

Our web host and email provider, Infomaniak Network SA, processes the data on our instructions under a data processing agreement. Servers are located in Switzerland, which the European Commission recognises as providing an adequate level of data protection.

We do not sell, share or pass your details to anyone else. If answering your enquiry requires a specialist, we ask you first and name them.

05 · How long we keep it

Enquiries that do not lead to a relationship are deleted after 12 months. Client records are kept for the duration of the engagement and afterwards for as long as Spanish commercial and tax law requires, normally six years.

06 · Your rights

You can ask us for a copy of your data, correct it, delete it, restrict or object to its use, or receive it in a portable form. Write to office@segundacasamallorca.es and we will answer within one month.

If you believe we have handled your data wrongly, you may complain to the Spanish data protection authority, the Agencia Española de Protección de Datos (aepd.es), or to the authority in your country of residence.
